  1                      A bill to be entitled

  2         An act relating to motorcycles; amending s.

  3         316.211, F.S.; requiring an insurance decal on

  4         specified license plates; authorizing law

  5         enforcement to stop persons riding a motorcycle

  6         without protective headgear to show proof of

  7         compliance with specified insurance

  8         requirements; providing penalties; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Paragraph (b) of subsection (3) of section

14  316.211, Florida Statutes, is amended to read:

15         316.211  Equipment for motorcycle and moped riders.--

16         (3)

17         (b)  Notwithstanding subsection (1), a person over 21

18  years of age may operate or ride upon a motorcycle without

19  wearing protective headgear securely fastened upon his or her

20  head if such person has a valid insurance decal, issued by the

21  Department of Highway Safety and Motor Vehicles or its

22  authorized agents, affixed to the license plate of the

23  motorcycle indicating that the person is covered by an

24  insurance policy providing for at least $10,000 in medical

25  benefits for injuries incurred as a result of a crash while

26  operating or riding on a motorcycle. A law enforcement officer

27  may stop any person operating or riding upon a motorcycle

28  without wearing protective headgear securely fastened upon his

29  or her head and may ask that person to show proof of

30  compliance with the insurance requirements of this paragraph

31  when a valid insurance decal is not affixed to the license

  1  plate of the motorcycle. If that person does not show proof of

  2  compliance he or she is subject to punishment in accordance

  3  with subsection (6).

  4         Section 2.  This act shall take effect October 1, 2001.

  7                          SENATE SUMMARY

  8    Requires valid insurance decals on license plates of
      motorcycles whose riders do not wear protective headgear.
  9    Authorizes law enforcement officers to stop persons
      riding without protective headgear to show proof of
10    compliance with insurance requirements when a valid
      insurance decal is not affixed to the license plate.
