1 A bill to be entitled
2 An act relating to health insurance; creating
3 ss. 627.6410 and 627.65747, F.S., and amending
4 s. 641.31, F.S.; prohibiting certain health
5 insurance policies and health maintenance
6 contracts from applying certain payments to
7 certain limits specified in the policies or
8 contracts; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 627.6410, Florida Statutes, is
13 created to read:
14 627.6410 Coverage for early intervention services;
15 limitation.--Any accident or health insurance policy that
16 covers a child in this state from birth to 3 years of age,
17 that provides for payments for early intervention services for
18 such child, and that is issued, amended, delivered, or renewed
19 in this state may not provide for application of such payments
20 against any maximum annual or lifetime limits specified in the
21 policy.
22 Section 2. Section 627.65747, Florida Statutes, is
23 created to read:
24 627.65747 Coverage for early intervention services;
25 limitation.--Any group, blanket, or franchise accident or
26 health insurance policy that covers a child in this state from
27 birth to 3 years of age, that provides for payments for early
28 intervention services for such child, and that is issued,
29 amended, delivered, or renewed in this state may not provide
30 for application of such payments against any maximum annual or
31 lifetime limits specified in the policy.

1 Section 3. Subsection (40) is added to section 641.31,
2 Florida Statutes, to read:
3 641.31 Health maintenance contracts.--
4 (40) Any health maintenance contract that covers a
5 child in this state from birth to 3 years of age, that
6 provides for payments for early intervention services for such
7 child, and that is issued, amended, delivered, or renewed in
8 this state may not provide for application of such payments
9 against any maximum annual or lifetime limits specified in the
10 contract.
11 Section 4. This act shall take effect October 1, 2001,
12 and shall apply to policies and contracts that are issued,
13 amended, delivered, or renewed in this state after that date.

16 SENATE SUMMARY

Provides that health insurance policies, group, blanket,
18 or franchise health insurance policies, and health
maintenance contracts that provide for payments for early
19 intervention services for children from birth to 3 years
of age may not apply such payments against any maximum
20 annual or lifetime limits specified in the policies or
contracts.
