12 recommended the following amendment:

14 Senate Amendment (with title amendment)
15 On page 6, between lines 20 and 21,
16
17 insert:
18 (12) All powers, duties, functions, rules, records,
19 personnel, property, and unexpended balances of
20 appropriations, allocations, and other funds of the Office of
21 the Secretary and the Office of Administrative Services of the
22 Department of Labor and Employment Security related to the
23 regulation of labor organizations under chapter 447, Florida
24 Statutes, and the administration of migrant labor and farm
25 labor laws under chapter 450, Florida Statutes, are
26 transferred by a type two transfer, as defined in s. 20.06(2),
27 Florida Statutes, from the Department of Labor and Employment
28 Security to the Department of Business and Professional
29 Regulation.
30 (13) Any other powers, duties, functions, rules,
31 records, property, and unexpended balances of appropriations,

1 allocations, and other funds of the Department of Labor and
2 Employment Security not otherwise transferred by this act,
3 relating to workplace regulation and enforcement, including,
4 but not limited to, those under chapter 448, Florida Statutes,
5 are transferred by a type two transfer, as defined in s.
6 20.06(2), Florida Statutes, from the Department of Labor and
7 Employment Security to the Department of Business and
8 Professional Regulation.
9 (14) All powers, duties, functions, rules, records,
10 personnel, property, and unexpended balances of
11 appropriations, allocations, and other funds of the
12 Unemployment Appeals Commission relating to the commission's
13 specified authority, powers, duties, and responsibilities are
14 transferred by a type two transfer, as defined in s. 20.06(2),
15 Florida Statutes, to the Agency for Workforce Innovation.
16 (15) All powers, duties, functions, rules, records,
17 personnel, property, and unexpended balances of
18 appropriations, allocations, and other funds of the Public
19 Employees Relations Commission relating to the commission's
20 specified authority, powers, duties, and responsibilities are
21 transferred by a type two transfer, as defined in s. 20.06(2),
22 Florida Statutes, to the Department of Management Services.
23 (16) The Office of Information Systems is transferred
24 by a type two transfer, as defined in s. 20.06(2), Florida
25 Statutes, from the Department of Labor and Employment Security
26 to the State Technology Office.
27 (17)(a) The records, property, and unexpended balances
28 of appropriations, allocations, and other funds and resources
29 of the Office of the Secretary and the Office of
30 Administrative Services of the Department of Labor and
31 Employment Security which support the activities and functions

1 transferred under subsections (12) and (13) to the Department
2 of Business and Professional Regulation are transferred as
3 provided in s. 20.06(2), Florida Statutes, to the Department
4 of Business and Professional Regulation.
5 (b) The records, property, and unexpended balances of
6 appropriations, allocations, and other funds and resources of
7 the Office of the Secretary and the Office of Administrative
8 Services of the Department of Labor and Employment Security
9 which support the activities and functions transferred under
10 subsection (14) to the Agency for Workforce Innovation are
11 transferred as provided in s. 20.06(2), Florida Statutes, to
12 the Agency for Workforce Innovation.
13 (c) The records, property, and unexpended balances of
14 appropriations, allocations, and other funds and resources of
15 the Office of the Secretary and the Office of Administrative
16 Services of the Department of Labor and Employment Security
17 which support the activities and functions transferred under
18 subsection (15) to the Department of Management Services are
19 transferred as provided in s. 20.06(2), Florida Statutes, to
20 the Department of Management Services.
21 (d) The records, property, and unexpended balances of
22 appropriations, allocations, and other funds and resources of
23 the Office of the Secretary and the Office of Administrative
24 Services of the Department of Labor and Employment Security
25 which support the activities and functions transferred under
26 subsection (6) to the State Technology Office are transferred
27 as provided in s. 20.06(2), Florida Statutes, to the State
28 Technology Office.
29 (18) This act does not affect the validity of any
30 judicial or administrative proceeding involving the department
31 of Labor and Employment security, which is pending as of the

1 effective date of any transfer under this act. The successor
2 department, agency, or entity responsible for the program,
3 activity, or function relative to the proceeding shall be
4 substituted, as of the effective date of the applicable
5 transfer under this act, for the Department of Labor and
6 Employment Security as a party in interest in any such
7 proceedings.
