  1                      A bill to be entitled

  2         An act relating to Broward County; authorizing

  3         local governments in the county to grant an

  4         exception from the concurrency requirement for

  5         transportation facilities under s. 163.3180,

  6         F.S., for certain developments; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  In addition to the exceptions provided in

12  section 163.3180(5)(b), Florida Statutes, a local government

13  in Broward County may grant an exception from the concurrency

14  requirement for transportation facilities pursuant to the

15  provisions of section 163.3180(5)(d), Florida Statutes, if the

16  proposed development is otherwise consistent with the adopted

17  local government comprehensive plan, and is a project that

18  promotes public transportation or is located within a Regional

19  Activity Center as described in and defined by the Broward

20  County Comprehensive Plan, and is within an area that contains

21  major public and private postsecondary institutions of higher

22  learning.

23         Section 2.  This act shall take effect upon becoming a

24  law.
