1 A bill to be entitled
2 An act relating to Lee County and the City of
3 Fort Myers; amending section 4, chapter 98-488,
4 Laws of Florida, as amended; providing for the
5 addition of a special election that may be
6 conducted by the city for the interlocal
7 agreement approval referendum; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 4 of chapter 98-488, Laws of
13 Florida, as amended by chapter 2000-413, Laws of Florida, is
14 amended to read:
15 Section 4. (1) Subsequent to the adoption of the
16 interlocal agreement between the city and the county, and
17 prior to the implementation of the proposed annexation by the
18 city of the described "Dunbar" and "Belle Vue" enclaves, a
19 referendum shall be held by the city within the proposed,
20 described enclave areas to be annexed, or at the election of
21 the city, in the city of Fort Myers and within the proposed,
22 described enclave areas to be annexed, for the ratification
23 and approval of the interlocal agreement by the registered
24 electorates therein pursuant to the provisions of s. 171.0413,
25 Florida Statutes, as amended.
26 (2) The interlocal agreement shall be presented to the
27 registered voters residing within the proposed annexed areas
28 as further described in section 2 of this act. The city may
29 also elect to submit the interlocal agreement to a separate
30 vote of the registered voters residing within the city at the
31 same time the referendum is held in the proposed enclave

1 areas. The procedures for conducting the referendum shall be
2 pursuant to the requirements as set out at s. 171.0413(2),
3 Florida Statutes. Upon a majority vote, of the combined
4 registered electors residing in both the "Dunbar" and "Belle
5 Vue" areas, or if the city elects to submit the interlocal
6 agreement to a separate vote of the registered voters residing
7 within the city, upon a majority vote of the electors of the
8 City of Fort Myers and a majority vote by the combined
9 electors residing in both "Dunbar" and "Belle Vue" areas, the
10 interlocal agreement shall be deemed to be ratified and
11 approved, and shall become effective as provided for in the
12 interlocal agreement, but otherwise for not more than 1 year
13 following the referendum. The referendum for ratification and
14 approval of the interlocal agreement for annexation may be
15 conducted by the city at any regular or special election
16 following the adoption of the interlocal agreement by the city
17 and the county.
18 Section 2. This act shall take effect upon becoming a
19 law.
