2 An act relating to the Immokalee Fire Control
3 District, Collier County; amending chapter
4 2000-393, Laws of Florida, to include specific
5 authorization of the imposition, collection,
6 and use of impact fees as provided in chapter
7 191, Florida Statutes; providing an effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 6 of section 3 of chapter 2000-393,
13 Laws of Florida, is amended to read:
14 Section 6. Taxes; non-ad valorem assessments; impact
15 fees; user charges.--
16 (1) GENERALLY.--The district board shall fix and cause
17 to be levied on all property of the district, a millage
18 sufficient to meet the requirements of the adopted budget;
19 provided, however, 2 mills is the maximum that can be levied
20 in any 1 year, except as provided in chapter 191, Florida
21 Statutes, or any other applicable general law or special law,
22 as said laws may be amended from time to time. In addition,
23 the district shall have such authority to levy non-ad valorem
24 assessments and charge impact fees and user charges as
25 prescribed herein and in chapter 191, Florida Statutes, and
26 all other applicable general law or special law, as said laws
27 may be amended from time to time.
28 (2) IMPACT FEES.--
29 (a) The general-purpose local government for Collier
30 County, within which the district lies, has not adopted an
31 impact fee for fire services which is distributed to the

1 district for construction within the district's jurisdictional
2 boundaries. Because of the population growth and resulting new
3 construction within the jurisdictional boundaries of the
4 district, the Legislature recognizes the district's need to
5 impose impact fees for new construction to pay for the cost of
6 new facilities and equipment, the need for which is in whole
7 or in part the result of said new construction.
8 (b) The district board has the right, at its sole
9 discretion, to establish a schedule of impact fees in
10 compliance with any standards set by general law or special
11 law, as said laws may be amended from time to time, for new
12 construction to pay for the cost of new facilities and
13 equipment of the district, the need for which is in whole or
14 in part the result of new construction within the
15 jurisdictional boundaries of the district. The impact fees
16 collected by the district under this subsection shall be kept
17 separate from other revenues of the district and must be used
18 exclusively to acquire, purchase, or construct new facilities
19 or portions thereof needed to provide fire protection and
20 emergency services to new construction. As used in this
21 subsection, "new facilities" means land, buildings, and
22 capital equipment, including, but not limited to, fire and
23 emergency vehicles, radio telemetry equipment, and other
24 firefighting or rescue equipment. The district board shall
25 maintain adequate records to ensure that impact fees are
26 expended only for permissible new facilities or equipment as
27 allowed by general law and special law, as said laws may be
28 amended from time to time.
29 Section 2. This act shall take effect upon becoming a
30 law.
