1 A bill to be entitled
2 An act relating to Broward County; extending
3 the corporate limits of the Town of
4 Lauderdale-By-The-Sea; prescribing procedures
5 for calculating revenues attributable to
6 utility taxes, utility franchise fees, and
7 other franchise fees; providing for the town to
8 collect franchise fees and utility taxes
9 collected by the county from a specified
10 unincorporated area; providing for an
11 interlocal agreement between Broward County and
12 the Town of Lauderdale-By-The-Sea; providing
13 for the effective date of annexation; providing
14 an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. The present corporate limits of the Town of
19 Lauderdale-By-The-Sea, Broward County, Florida, are hereby
20 extended and enlarged effective August 15, 2001, so as to
21 include, in addition to the territory presently within its
22 corporate limits, the area particularly described as follows:

24 Part #1 (south area):

26 Beginning at the point of intersection of the
27 south boundary line of Section 18, Township 49
28 South, Range 43 East with the ordinary low
29 watermark of the Atlantic Ocean, the POINT OF
30 BEGINNING for Part #1;

1 THENCE in a northerly direction along said
2 ordinary low watermark of the Atlantic Ocean to

22 Section 2. Pursuant to a majority vote as provided for
23 in chapter 99-465, Laws of Florida, the effective date of the
24 annexation of the Intracoastal Beach Area of unincorporated
25 Broward County into the Town of Lauderdale-By-The-Sea shall be
26 August 15, 2001.
27 Section 3. Notwithstanding the provisions of section
28 186.901, Florida Statutes, to the contrary, for the sole
29 purpose of calculating the revenues attributable to utility
30 taxes, utility franchise fees, or other franchise fees, the
31 calculation of the total population census of the town of

1 Lauderdale-by-the-Sea, beginning with the state's fiscal year
2 2001, shall include all of the residents of the Intracoastal
3 Beach Area of unincorporated Broward County added as a result
4 of chapter 99-465, Laws of Florida.
5 Section 4. Notwithstanding any general law or special
6 act to the contrary, Lauderdale-by-the-Sea shall have full
7 authority to collect all franchise fees and utility taxes
8 currently being collected by Broward County from the
9 unincorporated area known as Intracoastal Beach Area beginning
10 on the effective date of the annexation, August 15, 2001.
11 Section 5. An interlocal agreement shall be developed
12 between the governing bodies of Broward County and the Town of
13 Lauderdale-By-The-Sea regarding the annexation provided for in
14 chapter 99-465, Laws of Florida, and shall be executed prior
15 to August 15, 2001. The agreement shall include a financially
16 feasible plan for transitioning county services, buildings,
17 infrastructure, waterways, roads and rights-of-way, and
18 employees, including any provisions to jointly fund programmed
19 infrastructure improvements provided that the Town of
20 Lauderdale-By-The-Sea is not limited in its ability to receive
21 anticipated utility taxes, utility franchise fees, or other
22 franchise fees.
23 Section 6. This act shall take effect upon becoming a
24 law.
