  1                      A bill to be entitled

  2         An act relating to sentencing; amending s.

  3         944.17, F.S.; requiring that a prisoner

  4         sentenced for a crime committed during

  5         incarceration in the state correctional system

  6         serve the sentence for such crime in the state

  7         system, regardless of the length of sentence

  8         imposed; requiring that the sentence be served

  9         consecutive to any sentence previously imposed

10         on the prisoner; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Subsection (3) of section 944.17, Florida

15  Statutes, is amended to read:

16         944.17  Commitments and classification; transfers.--

17         (3)(a)  Notwithstanding the provisions of s. 948.03,

18  only those persons who are convicted and sentenced in circuit

19  court to a cumulative sentence of incarceration for 1 year or

20  more, whether sentence is imposed in the same or separate

21  circuits, may be received by the department into the state

22  correctional system. Such persons shall be delivered to the

23  custody of the department at such reception and classification

24  centers as shall be provided for this purpose.

25         (b)  Notwithstanding paragraph (a), any prisoner

26  incarcerated in the state correctional system who is convicted

27  in circuit or county court of a crime committed during that

28  incarceration shall serve the sentence imposed for that crime

29  within the state correctional system regardless of the length

30  of sentence or classification of the offense, and the sentence

  1  shall be served consecutive to any sentence previously imposed

  2  on the prisoner.

  3         Section 2.  This act shall take effect July 1, 2001.

  6                          SENATE SUMMARY

  7    Provides that a prisoner who is sentenced for a crime
      committed while incarcerated in the state correctional
  8    system be required to serve the sentence for that crime
      in the state system, regardless of the length of sentence
  9    imposed or the classification of the offense. Requires
      that the sentence be served consecutive to any sentence
10    previously imposed on the prisoner.
