11 The Committee on Judicial Oversight offered the following:

13 Amendment (with title amendment)
14 On page 2, between lines 11 and 12 of the bill
15
16 insert:
17 Section 2. Present paragraph (d) of subsection (1) of
18 section 800.04, Florida Statutes, is redesignated as paragraph
19 (e) and a new paragraph (d) is added to that section to read:
20 800.04 Lewd or lascivious offenses committed upon or
21 in the presence of persons less than 16 years of age.--
22 (1) DEFINITIONS.--As used in this section:
23 (d) "Presence" means that the victim of an act in
24 violation of this section is physically present where and when
25 the act occurs. The term does not mean that the victim must
26 actually see or have sensory awareness of the act.
