2 An act relating to public records exemption for
3 certain identification and computer security
4 algorithms in connection with campaign
5 treasurer's reports; creating s. 106.0706,
6 F.S.; providing exemptions from public records
7 requirements for personal identification
8 numbers of and computer security algorithms
9 required to maintain the security of
10 information submitted or received through an
11 electronic filing system for campaign
12 treasurer's reports; providing for future
13 review and repeal; providing a finding of
14 public necessity; providing a contingent
15 effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Section 106.0706, Florida Statutes, is
20 created to read:
21 106.0706 Electronic filing of campaign treasurer's
22 reports; confidentiality of personal identification numbers
23 and computer security algorithms.--All personal identification
24 numbers of, and all computer security algorithms required to
25 maintain the security of information submitted or received
26 through, the electronic filing system for campaign treasurer's
27 reports established under s. 106.0705 and held by the division
28 are confidential and exempt from s. 119.07(1) and s. 24(a),
29 Art. I of the State Constitution. This section is subject to
30 the Open Government Sunset Review Act of 1995 in accordance
31 with s. 119.15, and shall stand repealed on October 2, 2006,

1 unless reviewed and saved from repeal through reenactment by
2 the Legislature.
3 Section 2. The Legislature finds that it is a public
4 necessity to exempt from public records requirements all
5 personal identification numbers of, and all computer security
6 algorithms required to maintain the security of information
7 submitted or received through, the electronic filing system
8 for campaign treasurer's reports established under s.
9 106.0705, Florida Statutes, and held by the Division of
10 Elections, because release of such information could invite
11 criminal activity, such as unauthorized access to the
12 electronic filing system. Such unauthorized access could
13 affect the integrity of the information submitted and filed.
14 The Legislature also finds that the above exemption protects
15 the security of campaign treasurer's reports and the security
16 of the electronic filing system.
17 Section 3. This act shall take effect on the same date
18 that House Bill 273 or similar legislation creating s.
19 106.0705, Florida Statutes, to provide for electronic filing
20 of campaign treasurer's reports, takes effect, if such
21 legislation is adopted in the same legislative session or an
22 extension thereof.
