  1                 Senate Joint Resolution No. ____

  2         A joint resolution proposing the creation of

  3         Section 19 of Article X of the State

  4         Constitution, relating to windstorm insurance,

  5         to limit rate increases allowed for windstorm

  6         insurance and to authorize the Legislature to

  7         provide by general law for rate increases in

  8         excess of the limit.

10  Be It Resolved by the Legislature of the State of Florida:

11

12         That the following creation of Section 19 of Article X

13  of the State Constitution is agreed to and shall be submitted

14  to the electors of this state for approval or rejection at the

15  next general election or an at earlier special election

16  specifically authorized by law for that purpose:

17                            ARTICLE X

18                          MISCELLANEOUS

19         SECTION 19.  Rates for windstorm insurance coverage;

20  limitation.--The increase in rates for windstorm insurance

21  shall change only as provided in this section:

22         (a)  The rate for windstorm insurance may be changed

23  annually in the manner and at the rate permitted pursuant to

24  general law, but any increase in the rate may not exceed three

25  percent of the rate for the prior year.

26         (b)  The legislature may, by general law enacted by a

27  three-fifths vote of the membership of each house, provide for

28  rate increases exceeding the limitation prescribed in

29  subsection (a).

30         BE IT FURTHER RESOLVED that the following statement be

31  placed on the ballot:

  1                     CONSTITUTIONAL AMENDMENT

  2                      ARTICLE X, SECTION 19

  3         RATES FOR WINDSTORM INSURANCE.--Proposing an amendment

  4  to the State Constitution to limit rate increases for

  5  windstorm insurance to 3 percent of the rate for the previous

  6  year and to allow the Legislature, by an extraordinary vote,

  7  to allow rate increases in excess of this limit.
