11  Senator Constantine moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 20, between lines 11 and 12,
15  
16  insert:  
17         Section 10.  Effective upon this act becoming a law,
18  section 553.84, Florida Statutes, as amended by section 88 of
19  chapter 2000-141, Laws of Florida, is amended to read:
20         553.84  Statutory civil action.--Notwithstanding any
21  other remedies available, any person or party, in an
22  individual capacity or on behalf of a class of persons or
23  parties, damaged as a result of a violation of this part or
24  the Florida Building Code, has a cause of action in any court
25  of competent jurisdiction against the person or party who
26  committed the violation if the person or party obtains the
27  required building permits and any local government or public
28  agency with authority to enforce the Florida Building Code
29  approves the plans, the construction project passes all
30  required inspections under the code, and there is no personal
31  injury or damage to property other than the property that is

 1  the subject of the permits, plans, and inspections. This
 2  section does not apply unless the person or party knew or
 3  should have known that the violation existed, notwithstanding
 4  the approval of the permits, plans, and inspections.
