17  and insert in lieu thereof:  
18         (a)  An applicant for an adult open heart surgery
19  program who meets the special circumstances shall as a
20  condition for approval agree that the applicant shall provide
21  a minimum of 2 percent of its services to charity and Medicaid
22  patients each year as provided in s. 408.036(3)(i)2.e.
23         (b)  An applicant approved for an adult open heart
