1 A bill to be entitled
2 An act relating to benefits for district school
3 instructional personnel; amending s. 121.021,
4 F.S.; providing for a separate normal
5 retirement date for personnel employed by
6 district school boards under the Florida
7 Retirement System; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (29) of section 121.021, Florida
12 Statutes, as amended by section 4 of chapter 2000-169, Laws of
13 Florida, is amended to read:
14 121.021 Definitions.--The following words and phrases
15 as used in this chapter have the respective meanings set forth
16 unless a different meaning is plainly required by the context:
17 (29) "Normal retirement date" means the first day of
18 any month following the date a member attains one of the
19 following statuses:
20 (a)1. If a Regular Class member, the member:
21 a.1. Completes 6 or more years of creditable service
22 and attains age 62; or
23 b.2. Completes 30 years of creditable service,
24 regardless of age, which may include a maximum of 4 years of
25 military service credit as long as such credit is not claimed
26 under any other system.
27 2. If a Regular Class member, and the member is
28 employed by a district school board, the member completes 25
29 years of creditable service regardless of age, which may
30 include a maximum of 4 years of military service credit as
31 long as such credit is not claimed under any other system.

1 (b) If a Special Risk Class member, the member:
2 1. Completes 6 or more years of creditable service in
3 the Special Risk Class and attains age 55;
4 2. Completes 25 years of creditable service in the
5 Special Risk Class, regardless of age; or
6 3. Completes 25 years of creditable service and
7 attains age 52, which service may include a maximum of 4 years
8 of military service credit as long as such credit is not
9 claimed under any other system and the remaining years are in
10 the Special Risk Class.
11 (c) If a Senior Management Service Class member, the
12 member:
13 1. Completes 6 years of creditable service in the
14 Senior Management Service Class and attains age 62; or
15 2. Completes 30 years of any creditable service,
16 regardless of age, which may include a maximum of 4 years of
17 military service credit as long as such credit is not claimed
18 under any other system.
19 (d) If an Elected Officers' Class member, the member:
20 1. Completes 6 years of creditable service in the
21 Elected Officers' Class and attains age 62; or
22 2. Completes 30 years of any creditable service,
23 regardless of age, which may include a maximum of 4 years of
24 military service credit as long as such credit is not claimed
25 under any other system.

27 "Normal retirement age" is attained on the "normal retirement
28 date."
29 Section 2. This act shall take effect July 1, 2001.

2 LEGISLATIVE SUMMARY

Revises the definition of the term "normal retirement
4 date" for the purposes of the Florida Retirement System
to provide that a regular member of the system who is an
5 employee of a district school board reaches normal
retirement date after completing 25 years of creditable
6 service regardless of age.
