1 A bill to be entitled
2 An act relating to voting methods and
3 procedure; creating s. 101.005, F.S.; providing
4 for a uniform statewide voting system and
5 ballots; providing rulemaking authority to the
6 Department of State to adopt standards for the
7 system and requirements for the ballots;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 101.005, Florida Statutes, is
13 created to read:
14 101.005 Uniform statewide voting system and
15 ballots.--Notwithstanding any other provision of law to the
16 contrary, there shall be a uniform statewide voting system,
17 beginning with the primary and general elections held in 2002.
18 The uniform statewide voting system shall be the most
19 reliable, accurate, and secure electronic or electromechanical
20 voting system certified by the department as of September 30,
21 2001, and may be updated for subsequent elections as needed.
22 The ballots used by such system shall be uniform, to the
23 extent practicable, and must be approved by the department
24 prior to use in any election. The department may adopt rules
25 pursuant to ss. 120.536(1) and 120.54 necessary to specify
26 both the standards for the uniform statewide voting system,
27 including those relating to software, hardware, accuracy, and
28 security, and the requirements for the ballots used by such
29 system, including those relating to the order and manner of
30 arrangement of the names of candidates and issues in order to
31 ensure consistency and those relating to the placement of the

1 voting squares in order to eliminate confusion as to which
2 name or issue a square belongs.
3 Section 2. This act shall take effect upon becoming a
4 law.

Provides for a uniform statewide voting system and
