  2         An act relating to a public records exemption

  3         for certain information obtained by the Florida

  4         Tourism Industry Marketing Corporation;

  5         amending s. 288.1226, F.S., which provides an

  6         exemption from public records requirements for

  7         the identity of any person responding to

  8         marketing or research projects conducted by the

  9         corporation and for trade secrets obtained

10         pursuant thereto; reenacting such exemption and

11         removing the October 2, 2001, repeal thereof

12         scheduled under the Open Government Sunset

13         Review Act of 1995; providing an effective

14         date.

16  Be It Enacted by the Legislature of the State of Florida:

18         Section 1.  Notwithstanding the October 2, 2001, repeal

19  of said subsection scheduled pursuant to the Open Government

20  Sunset Review Act of 1995, subsection (8) of section 288.1226,

21  Florida Statutes, is reenacted and amended to read:

22         288.1226  Florida Tourism Industry Marketing

23  Corporation; use of property; board of directors; duties;

24  audit.--

25         (8)  The identity of any person who responds to a

26  marketing project or advertising research project conducted by

27  the corporation in the performance of its duties on behalf of

28  the commission, or trade secrets as defined by s. 812.081

29  obtained pursuant to such activities, are exempt from s.

30  119.07(1) and s. 24(a), Art. I of the State Constitution.

31  This subsection is subject to the Open Government Sunset

  1  Review Act of 1995 in accordance with s. 119.15, and shall

  2  stand repealed on October 2, 2001, unless reviewed and saved

  3  from repeal through reenactment by the Legislature.

  4         Section 2.  This act shall take effect October 1, 2001.
