2 An act relating to public records exemptions
3 for specified information relating to airports;
4 amending s. 331.22, F.S., which provides
5 exemptions from public records requirements for
6 airport security plans of an aviation authority
7 or county or municipal aviation department and
8 for other material that depicts critical
9 airport operating facilities; reenacting such
10 exemptions and removing the October 2, 2001,
11 repeal thereof scheduled under the Open
12 Government Sunset Review Act of 1995; providing
13 an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Notwithstanding the October 2, 2001, repeal
18 of said section scheduled pursuant to the Open Government
19 Sunset Review Act of 1995, section 331.22, Florida Statutes,
20 is reenacted and amended to read:
21 331.22 Certain information exempt from
22 disclosure.--Airport security plans of an aviation authority
23 created by act of the Legislature or of an aviation department
24 of a county or municipality which operates an international
25 airport are exempt from provisions of s. 119.07(1) and s.
26 24(a), Art. I of the State Constitution. In addition,
27 photographs, maps, blueprints, drawings, and similar materials
28 that depict critical airport operating facilities are exempt
29 from the provisions of s. 119.07(1) and s. 24(a), Art. I of
30 the State Constitution, to the extent that an aviation
31 authority created by act of the Legislature or an aviation

1 department of a county or municipality which operates an
2 airport reasonably determines that such items contain
3 information that is not generally known and that could
4 jeopardize the security of the airport; however, information
5 relating to real estate leases, layout plans, blueprints, or
6 information relevant thereto, is not to be included in this
7 exemption. The exemptions in this section are applicable only
8 to records held by an aviation authority created by act of the
9 Legislature or to records of a county or municipal aviation
10 department that operates an airport. The exemptions contained
11 in this section are subject to the Open Government Sunset
12 Review Act of 1995, in accordance with s. 119.15, and this
13 section shall stand repealed on October 2, 2001, unless
14 reviewed and saved from repeal through reenactment by the
15 Legislature.
16 Section 2. This act shall take effect October 1, 2001.
