2 An act relating to a public records exemption
3 for records relating to pawnbroker
4 transactions; amending s. 539.003, F.S., which
5 provides an exemption from public records
6 requirements for records relating to pawnbroker
7 transactions delivered to appropriate law
8 enforcement officials; reenacting such
9 exemption and removing the October 2, 2001,
10 repeal thereof scheduled under the Open
11 Government Sunset Review Act of 1995; providing
12 an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Notwithstanding the October 2, 2001, repeal
17 of said section scheduled pursuant to the Open Government
18 Sunset Review Act of 1995, section 539.003, Florida Statutes,
19 is reenacted and amended to read:
20 539.003 Confidentiality.--
21 (1) All records relating to pawnbroker transactions
22 delivered to appropriate law enforcement officials pursuant to
23 s. 539.001 are confidential and exempt from the provisions of
24 s. 119.07(1) and s. 24(a), Art. I of the State Constitution
25 and may be used only for official law enforcement purposes.
26 This section does not prohibit the disclosure by the
27 appropriate law enforcement officials of the name and address
28 of the pawnbroker, the name and address of the conveying
29 customer, or a description of pawned property to the alleged
30 owner of pawned property.

1 (2) This section is subject to the Open Government
2 Sunset Review Act of 1995 in accordance with s. 119.15 and
3 shall stand repealed on October 2, 2001, unless reviewed and
4 saved from repeal through reenactment by the Legislature.
5 Section 2. This act shall take effect October 1, 2001.
