13         Senate Amendment (with title amendment) 
14         On page 1, between lines 25 and 26,
15  
16  insert:  
17         Section 2.  Section 408.087, Florida Statutes, is
18  created to read:
19         408.087  Construction permits.--For a period of 1 year
20  after the effective date of this act, the Department of
21  Environmental Protection shall not issue any air-pollution
22  construction permit for any electric generating facility of
23  more than 5 megawatts unless it is located on or immediately
24  adjacent to a site previously used for power generation or a
25  site permitted by the department, or the Public Service
26  Commission has issued a determination of need for the
27  facility. This section does not apply to any electric
28  generating facility to be constructed by any electric utility
29  as defined in s. 366.02.
