  1                      A bill to be entitled

  2         An act relating to public records; amending s.

  3         408.185, F.S.; abrogating the repeal of

  4         provisions relating to confidential information

  5         submitted to the Office of the Attorney General

  6         for review of antitrust issues; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 408.185, Florida Statutes, is

12  amended to read:

13         408.185  Information submitted for review of antitrust

14  issues; confidentiality.--The following information held by

15  the Office of the Attorney General, which is submitted by a

16  member of the health care community pursuant to a request for

17  an antitrust no-action letter shall be confidential and exempt

18  from the provisions of s. 119.07(1) and s. 24(a), Art. I of

19  the State Constitution for 1 year after the date of

20  submission.

21         (1)  Documents that reveal trade secrets as defined in

22  s. 688.002.

23         (2)  Preferred provider organization contracts.

24         (3)  Health maintenance organization contracts.

25         (4)  Documents that reveal a health care provider's

26  marketing plan.

27         (5)  Proprietary confidential business information as

28  defined in s. 364.183(3).

30  This section is subject to the Open Government Sunset Review

31  Act of 1995 in accordance with s. 119.15, and shall stand

  1  repealed on October 2, 2001, unless reviewed and saved from

  2  repeal by reenactment of the Legislature.

  3         Section 2.  This act shall take effect July 1, 2001.

  7    Abrogates the repeal of s. 408.185, F.S., relating to
      confidential information submitted to the Office of the
