12 following amendment:

15 On page 4, lines 15-24, delete those lines
16
17 and insert:
18 Section 2. There is appropriated from nonrecurring
19 general revenue the sum of $2,600,000 to be paid to the
20 Guardianship of Kimberly Godwin, Jimmy Godwin, Guardian, as
21 relief to Kimberly Godwin for Kimberly Godwin's pain and
22 suffering.
23 Section 3. The Comptroller shall draw a warrant from
24 nonrecurring general revenue in the sum of $2,600,000 payable
25 to the Guardianship of Kimberly Godwin, Jimmy Godwin,
26 Guardian, to be placed in a Special Needs Trust created for
27 the exclusive use and benefit of Kimberly Godwin. After
28 payment of statutory attorney's fees and costs, the balance
29 shall be used to purchase an appropriate structured financial
30 plan, the proceeds of which shall be deposited into a Special
31 Needs Trust created for the exclusive use and benefit of

1 Kimberly Godwin.
2 Section 4. It is the intent of the Legislature that no
3 amount over $1,000 per month shall be withdrawn from the
4 Special Needs Trust without prior Court order upon a written
5 finding of necessity and appropriateness. Jimmy Godwin, as
6 parent and legal guardian of Kimberly Godwin, is directed to
7 petition the Court to amend the guardianship order to reflect
8 this legislative intent. Further, upon passage of this act,
9 Jimmy Godwin, is directed to forward a copy of this act to the
10 Clerk of the Court in Liberty County, Florida, for inclusion
11 in Kimberly Godwin's guardianship file.
12 Section 5. It is the further intent of the Legislature
13 that upon Kimberly Godwin's death, any funds remaining in the
14 Special Needs Trust after payment of any outstanding Medicaid
15 funds, shall revert to the general fund of the State of
16 Florida.
