1 A bill to be entitled
2 An act relating to pharmacy practice; creating
3 s. 465.0075, F.S.; authorizing licensure of
4 pharmacists by endorsement and providing
5 requirements therefor, including a fee;
6 providing for legislative review; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Section 465.0075, Florida Statutes, is
12 created to read:
13 465.0075 Licensure by endorsement; requirements;
14 fee.--
15 (1) The department shall issue a license by
16 endorsement to any applicant who applies to the department and
17 remits a nonrefundable fee of not more than $100, as set by
18 the board, and whom the board certifies:
19 (a) Has met the qualifications for licensure in s.
20 465.007(1)(b)-(c);
21 (b) Has obtained a passing score, as established by
22 rule of the board, on the licensure examination of the
23 National Association of Boards of Pharmacy or a similar
24 nationally recognized examination, if the board certifies that
25 the applicant has taken the required examination not more than
26 15 years prior to application;
27 (c)1. Has submitted evidence of the active licensed
28 practice of pharmacy, including practice in community or
29 public health by persons employed by a governmental entity, in
30 another jurisdiction for at least 2 of the immediately
31 preceding 5 years or evidence of successful completion of

1 board-approved postgraduate training or a board-approved
2 clinical competency examination within the year immediately
3 preceding application for licensure; or
4 2. Has completed an internship meeting the
5 requirements of s. 465.007(1)(c) within the 2 years
6 immediately preceding application; and
7 (d) Has obtained a passing score on the pharmacy
8 jurisprudence portions of the licensure examination, as
9 required by board rule.
10 (2) An applicant licensed in another state for a
11 period in excess of 2 years from the date of application for
12 licensure in this state shall submit a total of at least 30
13 hours of board-approved continuing education for the 2
14 calendar years immediately preceding application.
15 (3) The department may not issue a license by
16 endorsement to any applicant who is under investigation in any
17 jurisdiction for an act or offense that would constitute a
18 violation of this chapter until the investigation is complete,
19 at which time the provisions of s. 465.016 apply.
20 (4) The department may not issue a license by
21 endorsement to any applicant whose license to practice
22 pharmacy has been suspended or revoked in another state or who
23 is currently the subject of any disciplinary proceeding in
24 another state.
25 Section 2. During the 2006 Regular Session of the
26 Legislature, the appropriate committee of each house of the
27 Legislature shall review the effect of this act and make
28 recommendations to the presiding officer of that house
29 regarding such review.
30 Section 3. This act shall take effect upon becoming a
31 law.
