1 A bill to be entitled
2 An act relating to Medicaid eligibility;
3 amending s. 409.904, F.S.; providing Medicaid
4 eligibility for certain disabled persons under
5 a Medicaid buy-in program, subject to specific
6 federal authorization; directing the Agency for
7 Health Care Administration to seek a federal
8 grant, demonstration project, or waiver for
9 establishment of such buy-in program, subject
10 to a specific appropriation; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (9) is added to section 409.904,
16 Florida Statutes, to read:
17 409.904 Optional payments for eligible persons.--The
18 agency may make payments for medical assistance and related
19 services on behalf of the following persons who are determined
20 to be eligible subject to the income, assets, and categorical
21 eligibility tests set forth in federal and state law. Payment
22 on behalf of these Medicaid eligible persons is subject to the
23 availability of moneys and any limitations established by the
24 General Appropriations Act or chapter 216.
25 (9) Subject to specific federal authorization, a
26 person who, but for earnings in excess of the limit
27 established under s. 1905(q)(2)(B) of the Social Security Act,
28 would be considered eligible for supplemental security income,
29 who is at least 16 but less than 65 years of age, and whose
30 assets, resources, and earned or unearned income, or both, do
31 not exceed 250 percent of the most current federal poverty

1 level. Such persons may be eligible for Medicaid services as
2 part of a Medicaid buy-in established under s. 409.914(2)
3 specifically designed to accommodate those persons made
4 eligible for such a buy-in by Title II of Pub. L. No. 106-170.
5 Such a buy-in must include income-related premiums and cost
6 sharing.
7 Section 2. Subject to a specific appropriation, the
8 Agency for Health Care Administration is directed to seek a
9 federal grant, demonstration project, or waiver from the
10 United States Department of Health and Human Services for
11 purposes of establishing a Medicaid buy-in program for certain
12 disabled persons whose medical improvements permit them to
13 return to work. The services to be provided under the buy-in
14 are those medical assistance services required to enable such
15 individuals to remain employed. The grant, demonstration
16 project, or waiver application shall be submitted to the
17 Secretary of Health and Human Services at such time, in such
18 manner, and containing such information as the secretary
19 requires, as authorized under Title II of Pub. L. No. 106-170,
20 the "Ticket to Work and Work Incentives Act of 1999."
21 Section 3. This act shall take effect October 1, 2001.

24 SENATE SUMMARY
25 Provides Medicaid eligibility under a Medicaid buy-in
program to provide medical assistance to disabled persons
26 who meet described criteria, subject to specific federal
authorization. Subject to a specific appropriation,
27 directs the Agency for Health Care Administration to seek
a grant, demonstration project, or waiver from the U.S.
28 Secretary of Health and Human Services for the purpose of
establishing such a buy-in program.
