  1                      A bill to be entitled

  2         An act relating to hunting; amending s. 372.57,

  3         F.S.; providing that the Fish and Wildlife

  4         Conservation Commission may not sponsor,

  5         conduct, or designate by rule special days for

  6         hunting by youths under 16 years of age in any

  7         wildlife management area; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (6) of section 372.57, Florida

13  Statutes, is amended to read:

14         372.57  Licenses and permits; exemptions; fees.--No

15  person, except as provided herein, shall take game, freshwater

16  fish, or fur-bearing animals within this state without having

17  first obtained a license, permit, or authorization and paid

18  the fees hereinafter set forth, unless such license is issued

19  without fee as provided in s. 372.561. Such license, permit,

20  or authorization shall authorize the person to whom it is

21  issued to take game, freshwater fish, or fur-bearing animals

22  in accordance with law and commission rules. Such license,

23  permit, or authorization is not transferable.  Each license or

24  permit must bear on its face in indelible ink the name of the

25  person to whom it is issued and other information requested by

26  the commission. Such license, permit, or authorization issued

27  by the commission or any agent must be in the personal

28  possession of the person to whom issued while taking game,

29  freshwater fish, or fur-bearing animals. The failure of such

30  person to exhibit such license, permit, or authorization to

31  the commission or its wildlife officers, when such person is

  1  found taking game, freshwater fish, or fur-bearing animals, is

  2  a violation of law.  A positive form of identification is

  3  required when using an authorization, a lifetime license, a

  4  5-year license, or when otherwise required by the license or

  5  permit.  The lifetime licenses and 5-year licenses provided

  6  herein shall be embossed with the name, date of birth, date of

  7  issuance, and other pertinent information as deemed necessary

  8  by the commission.  A certified copy of the applicant's birth

  9  certificate shall accompany each application for a lifetime

10  license for a resident 12 years of age or younger. Each

11  applicant for a license, permit, or authorization shall

12  provide the applicant's social security number on the

13  application form. Disclosure of social security numbers

14  obtained through this requirement shall be limited to the

15  purpose of administration of the Title IV-D child support

16  enforcement program and use by the commission, and as

17  otherwise provided by law.

18         (6)(a)  The commission may designate by rule no more

19  than 2 consecutive or nonconsecutive days in each year as free

20  fishing days. Notwithstanding any other provision of this

21  chapter, any person may take freshwater fish for noncommercial

22  purposes on a free fishing day without obtaining or possessing

23  a license or paying a license fee as prescribed in this

24  section.  A person who takes freshwater fish on a free fishing

25  day without obtaining a license or paying a fee must comply

26  with all laws and regulations governing holders of a fishing

27  license and all other conditions and limitations regulating

28  the taking of freshwater fish as are imposed by law or rule.

29         (b)  The commission may not sponsor, conduct, or

30  designate by rule special days for hunting by youths under the

31  age of 16 years in any area designated by the commission as a

  1  wildlife management area, notwithstanding that such youths are

  2  required to be accompanied by an adult.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
