13         Senate Amendment 
14         On page 4, line 18, through page 5, line 9, delete
15  those lines
16  
17  and insert:  
18         (a)  One who lacks a fixed, regular nighttime
19  residence;
20         (b)  One who has a primary nighttime residence that is:
21         1.  A supervised publicly or privately operated shelter
22  designed to provide temporary living accommodations, including
23  welfare hotels, congregate shelters, and transitional housing
24  for the mentally ill;
25         2.  An institution that provides a temporary residence
26  for individuals intended to be institutionalized; or
27         3.  A public or private place not designed for, or
28  ordinarily used as, a regular sleeping accommodation for human
29  beings; or
30         (c)  One who temporarily resides with an adult other
31  than his or her parent or guardian because the parent or

 1  guardian is suffering financial hardship.

 3  A child who is imprisoned, detained, or in the custody of the
 4  state pursuant to a state or federal law is not a homeless
 5  child. whose primary nighttime residence is in a supervised
 6  publicly or privately operated shelter for temporary
 7  accommodations or in a public or private place not designated
 8  for, or ordinarily used for, continuing human habitation.
