1 A bill to be entitled
2 An act relating to public records; amending s.
3 288.1226, F.S.; abrogating the scheduled repeal
4 of a public records exemption for trade secrets
5 and for the identity of respondents to
6 marketing or advertising research projects of
7 the Florida Tourism Industry Marketing
8 Corporation; eliminating an obsolete reference
9 to legislative review; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (8) of section 288.1226, Florida
15 Statutes, is amended to read:
16 288.1226 Florida Tourism Industry Marketing
17 Corporation; use of property; board of directors; duties;
18 audit.--
19 (8) The identity of any person who responds to a
20 marketing project or advertising research project conducted by
21 the corporation in the performance of its duties on behalf of
22 the commission, or trade secrets as defined by s. 812.081
23 obtained pursuant to such activities, are exempt from s.
24 119.07(1) and s. 24(a), Art. I of the State Constitution.
25 This subsection is subject to the Open Government Sunset
26 Review Act of 1995 in accordance with s. 119.15, and shall
27 stand repealed on October 2, 2001, unless reviewed and saved
28 from repeal through reenactment by the Legislature.
29 Section 2. This act shall take effect October 1, 2001.
