3 s. 218.503, F.S.; clarifying language;
4 extending the repeal date for provisions which
5 allow certain municipalities that have been
6 declared in a state of financial emergency to
7 impose a per-vehicle surcharge on revenues from
8 the sale or rental of space at parking
9 facilities; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsection (5) of section 218.503, Florida
14 Statutes, is amended to read:
15 218.503 Determination of financial emergency.--
16 (5)(a) The governing authority of any municipality
17 with a resident population of 300,000 or more on April 1,
18 1999, and which has been declared in a state of financial
19 emergency pursuant to this section within the previous 2
20 fiscal years previous to that date may impose a discretionary
21 per-vehicle surcharge of up to 20 percent on the gross
22 revenues of the sale, lease, or rental of space at parking
23 facilities within the municipality that are open for use to
24 the general public.
25 (b) A municipal governing authority that imposes the
26 surcharge authorized by this subsection may use the proceeds
27 of such surcharge for the following purposes only:
28 1. No less than 60 percent and no more than 80 percent
29 of the surcharge proceeds shall be used by the governing
30 authority to reduce its ad valorem tax millage rate or to
31 reduce or eliminate non-ad valorem assessments.

1 2. A portion of the balance of the surcharge proceeds
2 shall be used by the governing authority to increase its
3 budget reserves; however, the governing authority shall not
4 reduce the amount it allocates for budget reserves from other
5 sources below the amount allocated for reserves in the fiscal
6 year prior to the year in which the surcharge is initially
7 imposed. When a 15-percent budget reserve is achieved, based
8 on the average gross revenue for the most recent 3 prior
9 fiscal years, the remaining proceeds from this subparagraph
10 shall be used for the payment of annual debt service related
11 to outstanding obligations backed or secured by a covenant to
12 budget and appropriate from non-ad valorem revenues.
13 (c) This subsection is repealed on June 30, 2007 2006.
14 Section 2. This act shall take effect upon becoming a
15 law.
