  1                      House Joint Resolution

  2         A joint resolution proposing the creation of

  3         Section 7 of Article VIII of the State

  4         Constitution, relating to amending certain

  5         county charters by special law.

  7  Be It Resolved by the Legislature of the State of Florida:

  8

  9         That the creation of Section 7 of Article VIII of the

10  State Constitution as set forth below is agreed to and shall

11  be submitted to the electors of Florida for approval or

12  rejection at the general election to be held in November 2002:

13                           ARTICLE VIII

14                         LOCAL GOVERNMENT

15         Section 7.  Special laws amending county home rule

16  charters.--Notwithstanding any limitation under this article,

17  the charter of any county which has adopted a home rule

18  charter may be amended by special law approved by vote of the

19  electors of the county and, if approved, shall be deemed an

20  amendment of the charter by the electors of the county.

21         BE IT FURTHER RESOLVED that in accordance with the

22  requirements of section 101.161, Florida Statutes, the

23  substance of the amendment proposed herein shall appear on the

24  ballot as follows:

25       AUTHORIZING AMENDMENTS TO COUNTY HOME RULE CHARTERS

26              BY SPECIAL LAW APPROVED BY REFERENDUM

27         Proposing the creation of Section 7 of Article VIII of

28  the State Constitution to authorize amendment of a county home

29  rule charter by special law approved by vote of the electors

30  of the county.
