18 Section 13. Subsection (1) of section 392.55, Florida
19 Statutes, is amended to read:
20 392.55 Physical examination and treatment.--
21 (1) Subject to the provisions of subsections (3) and
22 (4), the department and its authorized representatives may
23 petition the circuit court to examine or cause to be examined,
24 or treat to cure or cause to be treated to cure, by any means
25 deemed necessary by a physician, any person who has, or is
26 reasonably suspected of having or having been exposed to,
27 active tuberculosis.
28 Section 14. Subsection (6) of section 392.62, Florida
29 Statutes, is added to read:
30 (6) The department shall, within 30 days after
31 hospitalization, petition the circuit court for a limited

1 guardian pursuant to chapter 744, for any individual ordered
2 to the hospital, who a psychiatrist determines to be incapable
3 of making medical decisions. For the period of time between
4 hospitalization and the court's ruling on said petition, the
5 department's medical staff is authorized to use or cause to be
6 used appropriate means, including invasive procedures, to set
7 the matter for hearing as expeditiously as possible. The
8 duties and obligations of a limited guardian appointed by the
9 court pursuant to this subsection shall expire upon the ward's
10 discharge from the hospital or upon the court's order prior to
11 discharge. Any person may petition the court for termination
12 of the limited guardianship prior to the ward's discharge from
13 the hospital in accordance with chapter 744, part VII.
