13         Amendment (with title amendment) 
14         On page 24, between lines 19 and 20

16  insert:  
17         Section 20.  Paragraph (b) of subsection (1) and
18  paragraph (a) of subsection (2) of section 743.0645, Florida
19  Statutes, are amended to read:
20         743.0645  Other persons who may consent to medical care
21  or treatment of a minor.--
22         (1)  As used in this section, the term:
23         (b)  "Medical care and treatment" includes ordinary and
24  necessary medical and dental examination and treatment,
25  including blood testing, preventive care including ordinary
26  immunizations, tuberculin testing, and well-child care, but
27  does not include surgery, general anesthesia, provision of
28  psychotropic medications, or other extraordinary procedures
29  for which a separate court order, power of attorney, or
30  informed consent as provided by law is required.
31         (2)  Any of the following persons, in order of priority

HOUSE AMENDMENT Bill No. HB 475 Barcode 724989 Amendment No. 12 (for drafter's use only) 1 listed, may consent to the medical care or treatment of a 2 minor who is not committed to the Department of Children and 3 Family Services or the Department of Juvenile Justice or in 4 their custody under chapter 39, chapter 984, or chapter 985 5 when, after a reasonable attempt, a person who has the power 6 to consent as otherwise provided by law cannot be contacted by 7 the treatment provider and actual notice to the contrary has 8 not been given to the provider by that person: 9 (a) A person who possesses a power of attorney to 10 provide medical consent for the minor. A power of attorney to 11 provide medical consent for a minor executed after July 1, 12 2001, includes the power to consent to medically necessary 13 surgical and general anesthesia services for the minor unless 14 such services are excluded by the individual executing the 15 power of attorney. 16 17 There shall be maintained in the treatment provider's records 18 of the minor documentation that a reasonable attempt was made 19 to contact the person who has the power to consent. 20 21 22 ================ T I T L E A M E N D M E N T =============== 23 And the title is amended as follows: 24 On page 2, line 15, after the word and semicolon 25 "programs;" 26 27 28 insert: 29 amending s. 743.0645, F.S.; providing that a 30 power of attorney to provide such consent 31 includes the power to consent to surgical and 2 File original & 9 copies 03/20/01 hjo0006 08:02 pm 00475-jo -724989
