  1                      House Joint Resolution

  2         A joint resolution proposing an amendment to

  3         Section 4 of Article VI of the State

  4         Constitution, relating to suffrage and

  5         elections, to authorize the Legislature to

  6         provide the conditions under which a convicted

  7         felon's right to register or vote may be

  8         restored.

10  Be It Resolved by the Legislature of the State of Florida:

11

12         That the amendment to Section 4 of Article VI of the

13  State Constitution set forth below is agreed to and shall be

14  submitted to the electors of Florida for approval or rejection

15  at the general election to be held in November 2002:

16         SECTION 4.  Disqualifications.--

17         (a)  No person convicted of a felony, or adjudicated in

18  this or any other state to be mentally incompetent, shall be

19  qualified to vote or hold office until restoration of civil

20  rights or removal of disability. No person convicted of a

21  felony shall be qualified to vote until the person's right to

22  register or vote has been restored, as provided by law. No

23  person adjudicated in this state to be mentally incompetent

24  shall be qualified to vote until removal of disability.

25         (b)  No person may appear on the ballot for re-election

26  to any of the following offices:

27         (1)  Florida representative,

28         (2)  Florida senator,

29         (3)  Florida Lieutenant governor,

30         (4)  any office of the Florida cabinet,

31         (5)  U.S. Representative from Florida, or

  1         (6)  U.S. Senator from Florida

  2

  3  if, by the end of the current term of office, the person will

  4  have served (or, but for resignation, would have served) in

  5  that office for eight consecutive years.

  6         BE IT FURTHER RESOLVED that in accordance with the

  7  requirements of section 101.161, Florida Statutes, the title

  8  and substance of the amendment proposed herein shall appear on

  9  the ballot as follows:

10                QUALIFICATIONS OF FELONS TO VOTE.

11         Proposes an amendment to the State Constitution

12  authorizing the Legislature to provide the conditions under

13  which a convicted felon's right to register or vote may be

14  restored by statute.
