1 A bill to be entitled
2 An act relating to Volusia County; directing
3 the Board of County Commissioners to issue a
4 certificate of public convenience and necessity
5 to an applicant for licensure as a basic life
6 support or advanced life support service that
7 will operate in a municipality within the
8 county that has a population greater than
9 30,000 upon request of the municipality, under
10 specified conditions; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. The Board of County Commissioners of
16 Volusia County shall issue the certificate of public
17 convenience and necessity required by section 401.25, Florida
18 Statutes, to an applicant for licensure as a basic life
19 support or advanced life support service that will operate in
20 a municipality within the county that has a population greater
21 than 30,000 if:
22 (1) The governing body of the municipality has adopted
23 by ordinance reasonable standards for such certificates of
24 public convenience and necessity in accordance with applicable
25 requirements of section 401.25, Florida Statutes, and
26 certifies that the applicant meets those standards.
27 (2) The governing body of the municipality has
28 considered the recommendations of appropriate agencies under
29 its jurisdiction with respect to operation of the service
30 within the municipality, and has, by majority vote, requested
31 the county to issue the certificate.

1 Section 2. This act, except for this section which
2 shall take effect upon becoming a law, shall take effect only
3 upon approval by a majority vote of the electors of Volusia
4 County voting in a referendum election to be called and held
5 by the Board of County Commissioners of Volusia County at the
6 next general election. There shall be at least 30 days' notice
7 of the election as provided by section 100.342, Florida
8 Statutes. The election required by this section shall be paid
9 for by Volusia County, and the expenditures of funds for this
10 purpose is a proper county expense.
