  1                      A bill to be entitled

  2         An act relating to district school personnel;

  3         amending s. 231.40, F.S.; providing for use of

  4         certain donated sick leave and for restrictions

  5         on usage; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Paragraph (e) is added to subsection (3) of

10  section 231.40, Florida Statutes, to read:

11         231.40  Sick leave.--

12         (3)  PROVISIONS GOVERNING SICK LEAVE.--The following

13  provisions shall govern sick leave:

14         (e)  Use by family member.--Each district school system

15  must provide a policy under which a district employee may

16  authorize his or her spouse, child, parent, or sibling who is

17  also a district employee to use sick leave that has accrued to

18  the authorizing employee. In developing the policy, the

19  district school board must provide that the recipient may not

20  use the donated sick leave until all of his or her sick leave

21  has been depleted, excluding sick leave from a sick leave

22  pool, if the recipient participates in a sick leave pool.

23  Donated sick leave under this paragraph shall have no terminal

24  value as provided in this section.

25         Section 2.  This act shall take effect July 1, 2001.
