1 A bill to be entitled
2 An act relating to driver's licenses; amending
3 ss. 322.055, 322.056, F.S.; prescribing duty of
4 the Department of Highway Safety and Motor
5 Vehicles to revoke or withhold a driver's
6 license or driving privilege when that penalty
7 is prescribed by law; providing an effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Subsection (5) of section 322.055, Florida
13 Statutes, is amended to read:
14 322.055 Revocation or suspension of, or delay of
15 eligibility for, driver's license for persons 18 years of age
16 or older convicted of certain drug offenses.--
17 (5) If the court fails to direct the department to
18 revoke or withhold issuance of a person's driver's license or
19 driving privilege when required under this section or if the
20 period of revocation was not specified by the court at the
21 time of imposing sentence or within 30 days thereafter, the
22 department shall forthwith revoke or withhold issuance of the
23 person's driver's license or driving privilege as required by
24 this section. Each clerk of court shall promptly report to the
25 department each conviction for the possession or sale of,
26 trafficking in, or conspiracy to possess, sell, or traffic in
27 a controlled substance.
28 Section 2. Subsection (6) is added to section 322.056,
29 Florida Statutes, to read:
30 322.056 Mandatory revocation or suspension of, or
31 delay of eligibility for, driver's license for persons under

1 age 18 found guilty of certain alcohol, drug, or tobacco
2 offenses; prohibition.--
3 (6) If the court fails to direct the department to
4 revoke or withhold issuance of a person's driver's license or
5 driving privilege when required under this section or if the
6 period of revocation was not specified by the court at the
7 time of imposing sentence or within 30 days thereafter, the
8 department shall forthwith revoke or withhold issuance of the
9 person's driver's license or driving privilege as required by
10 this section. Each clerk of court shall promptly report to the
11 department each finding of guilt or delinquency for a
12 violation of s. 562.11(2), s. 562.111, s. 569.11, or chapter
13 893.
14 Section 3. This act shall take effect October 1, 2001.

17 SENATE SUMMARY
18 Requires the Department of Highway Safety and Motor
Vehicles to revoke or withhold issuance of a driver's
19 license or driving privilege when that penalty is
prescribed for certain alcohol, drug, or tobacco offenses
20 even though the court has failed to direct that action
or, if it has directed the revocation, has failed to
21 specify the period of revocation. Requires clerks of
court to report to the department findings of guilt or
22 delinquency for specified beverage law, tobacco, or drug
violations.
