11 The Committee on Comprehensive Planning, Local and Military
12 Affairs recommended the following amendment:

15 On page 1, line 23, through page 2, line 20, delete
16 those lines
17
18 and insert:
19 and
20 WHEREAS, the case went to trial in 1999, and the jury
21 found Orange County to be at fault but also allocated some
22 fault to the driver of the other vehicle, and judgment was
23 rendered in favor of the plaintiff for the sum of $380,971,
24 and
25 WHEREAS, Orange County appealed the jury's verdict, but
26 the verdict was affirmed per curiam, and
27 WHEREAS, Orange County has paid the $100,000 that is
28 the maximum amount allowed under section 768.28, Florida
29 Statutes, NOW, THEREFORE,

31 Be It Enacted by the Legislature of the State of Florida:

Amendment No. 1
1 Section 1. The facts stated in the preamble to this
2 act are found and declared to be true.
3 Section 2. Orange County is authorized and directed to
4 compensate Pamela McMahan San Juan in the amount of
5 $156,812.53 for injuries and damages sustained and for medical
6 expenses, out of the funds of Orange County not otherwise
7 appropriated.
8 Section 3. Orange County is authorized and directed to
9 compensate Orlando Regional Healthcare System, Inc., in the
10 amount of the Final Judgment entered in favor of the plaintiff
11 in the pending case of Orlando Regional Healthcare System,
12 Inc. v. Pamela San Juan, Case No. CI98-6501-34, in the Circuit
13 Court of the Ninth Judicial Circuit in and for Orange County,
14 Florida, but such compensation shall not exceed $64,866.06.
15 The County shall compensate Orlando Regional Healthcare
16 System, Inc., out of the funds of Orange County not otherwise
17 appropriated.
18 Section 4. This act shall take effect upon becoming a
19 law.
