18 At the regular session immediately following the submission of
19 the agency unit cost summary, the Legislature shall reduce in
20 the General Appropriations Act for the ensuing fiscal year, by
21 an amount equal to at least 10 percent of the allocation for
22 the fiscal year preceding the current fiscal year, the funding
23 of each state agency that fails to submit the report required
24 under this subsection.
25 Section 3. Subsections (8), (9), and (10) of section
26 216.181, Florida Statutes, are repealed.
27 Section 4. Subsection (1) of section 216.251, Florida
28 Statutes, is amended to read:
29 216.251 Salary appropriations; limitations.--
30 (1) Except as provided in s. 216.262(1)(h), the annual
31 rate of salary of any officer or employee filling the position

1 specifically named in an item in the appropriations acts shall
2 be as provided in one of the following paragraphs:
3 (a) In the amount appropriated for such position;
4 (b) The amount appropriated in an item for the named
5 positions in that item, shall be divided by the indicated
6 number of such positions, and the resulting quotient shall be
7 the annual rate of salary of each such position; or
8 (c) Within the amounts appropriated where such salary
9 may be otherwise fixed pursuant to law.
10 Section 5. Paragraph (h) is added to subsection (1) of
11 section 216.262, Florida Statutes, to read:
12 216.262 Authorized positions.--
13 (1)
14 (h) The Legislature recognizes the value of providing
15 incentives to retain a quality workforce and that, oftentimes,
16 necessary efficiency and cost-saving measures may lead to
17 increased workloads and demands on the state workforce.
18 Therefore, it is the intent of the Legislature to allow
19 agencies to retain a portion of the savings that would be
20 generated based on changes to authorized positions and to use
21 those savings for permanent salary increases. To be eligible,
22 an agency must submit to the Legislative Budgeting Commission
23 its plan identifying the modification to an approved program
24 resulting in efficiency and cost savings. The agency's plan
25 must demonstrate how the agency intends to meet its goals and
26 objectives established in the long-range program plan, as well
27 as meet the performance standards established by the
28 Legislature. The Legislative Budgeting Commission shall
29 determine the amount to be retained by the agency. In
30 determining that amount, the Legislative Budgeting Commission
31 shall consider the actual savings for the current year and the

1 annualized savings. The amount to be retained must be set by
2 the Legislative Budget Commission at no less than 10 percent
3 and no more than 30 percent of the actual savings and must be
4 used for permanent salary increases that are specified in the
5 agency's plan.
6 Section 6. Section 216.1826, Florida Statutes, is
7 created to read:
8 216.1826 Activity-based planning and budgeting.--
9 (1) Beginning July 1, 2003, and continuing thereafter,
10 the state budget must be structured to encompass the
11 principles of activity-based planning and budgeting. In
12 preparation for the legislative budget requests and long-range
13 program plans for fiscal year 2003-2004, agencies shall work
14 in consultation with the Executive Office of the Governor and
15 with the appropriations and appropriate substantive committees
16 of the Legislature to identify and reach consensus on the
17 appropriate services and activities for activity-based
18 budgeting. It is the intent of the Legislature that all
19 dollars within an agency be allocated to the appropriate
20 activity for budgeting purposes. Additionally, agencies shall
21 examine approved performance measures and recommend any
22 changes so that outcomes are clearly delineated for each
23 service or program, or both, as appropriate, and outputs are
24 aligned with activities. Output measures must be capable of
25 being used to generate a unit cost for each activity,
26 resulting in a true accounting of what the state should spend
27 on each activity it provides and what the state should expect
28 to accomplish with those funds.
29 (2) Directions for developing activity-based budgets
30 and plans must be included in the instructions for the
31 Legislative Budget Request and Long-range Program Plan for
