8 providing exceptions; authorizing the
9 Department of Education to adopt rules;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Short title.--This act may be cited as the
15 "David Levitt School Food Anti-Hunger Act of 2001."
16 Section 2. Subsection (6) is added to section 228.195,
17 Florida Statutes, to read:
18 228.195 School food service programs.--
19 (6) DISPOSITION OF UNUSED FOOD.--
20 (a) Pursuant to s. 570.0725, the Legislature wants
21 school districts to donate, on a weekly basis, in accordance
22 with health, safety, and sanitation guidelines, any unused
23 food products that would otherwise be disposed of in the trash
24 to programs in their communities that fight hunger.
25 (b) School districts shall enter into agreements with
26 charities and not-for-profit corporations, including
27 faith-based organizations, in their communities whose missions
28 include providing meals to hungry families.
29 (c) School districts in counties with no hunger
30 assistance programs or districts with no substantial unused
31 food products are exempt from this subsection.

1 (d) The Department of Education is authorized to adopt
2 rules to ensure that the goals stated in this subsection are
3 met.
4 Section 3. This act shall take effect upon becoming a
5 law.
