17  and insert in lieu thereof:  
18         4.  For fiscal year 2002-2003, $200 million; and
19         5.  For all subsequent fiscal years, an amount equal to
20  the greater of $40 million or 10 percent of the payments
21  deposited into the Tobacco Settlement Clearing Trust Fund.
22         (c)  Amounts to be transferred under subparagraphs
23  (b)2., 3., 4., and 5. may be reduced by an amount equal to the
24  lesser of $200 million or the amount the endowment receives in
25  that fiscal year from the sale of the state's right, title,
26  and interest in and to the tobacco settlement agreement.
