1 House Joint Resolution
2 A joint resolution proposing a revision of
3 Article XI, Section 5 of the State Constitution
4 requiring the Legislature to provide by general
5 law for the provision of an economic impact
6 statement of each proposed amendment or
7 revision to the State Constitution prior to its
8 adoption by the voters of the state.

10 Be It Resolved by the Legislature of the State of Florida:
11
12 That the amendment to Section 5 of Article XI of the
13 State Constitution set forth below is agreed to and shall be
14 submitted to the electors of Florida for approval or rejection
15 at the general election to be held in November 2002:
16 SECTION 5. Amendment or revision election.--
17 (a) A proposed amendment to or revision of this
18 constitution, or any part of it, shall be submitted to the
19 electors at the next general election held more than ninety
20 days after the joint resolution, initiative petition or report
21 of revision commission, constitutional convention or taxation
22 and budget reform commission proposing it is filed with the
23 custodian of state records, unless, pursuant to law enacted by
24 the affirmative vote of three-fourths of the membership of
25 each house of the legislature and limited to a single
26 amendment or revision, it is submitted at an earlier special
27 election held more than ninety days after such filing.
28 (b) The legislature shall provide by general law,
29 prior to the holding of an election pursuant to this section,
30 for the provision of a statement to the public regarding the

1 probable financial impact of any proposed revision or
2 amendment.
3 (c)(b) Once in the tenth week, and once in the sixth
4 week immediately preceding the week in which the election is
5 held, the proposed amendment or revision, with notice of the
6 date of election at which it will be submitted to the
7 electors, shall be published in one newspaper of general
8 circulation in each county in which a newspaper is published.
9 (d)(c) If the proposed amendment or revision is
10 approved by vote of the electors, it shall be effective as an
11 amendment to or revision of the constitution of the state on
12 the first Tuesday after the first Monday in January following
13 the election, or on such other date as may be specified in the
14 amendment or revision.
15 BE IT FURTHER RESOLVED that in accordance with the
16 requirements of section 101.161, Florida Statutes, the title
17 and substance of the amendment proposed herein shall appear on
18 the ballot as follows:
19 ECONOMIC IMPACT STATEMENTS FOR
20 PROPOSED CONSTITUTIONAL AMENDMENTS OR REVISIONS
21 Requires the Legislature to provide by general law for
22 the provision of an economic impact statement to the public
23 prior to the public voting on an amendment or revision of the
24 Florida Constitution.
