  1                      A bill to be entitled

  2         An act relating to elections; amending s.

  3         100.091, F.S.; providing for the holding of the

  4         second primary election concurrently with the

  5         general election under certain circumstances;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Subsection (1) of section 100.091, Florida

11  Statutes, is amended to read:

12         100.091  Second primary election.--

13         (1)(a)  In each year in which a general election is

14  held, a second primary election for nomination of candidates

15  of political parties where nominations were not made in the

16  first primary election shall be held on the Tuesday 5 weeks

17  prior to the general election.

18         (b)  Notwithstanding paragraph (a), in any county in

19  which all contests to be held at the second primary are open

20  to all qualified electors regardless of party affiliation, the

21  second primary election shall be held concurrently with the

22  general election.

23         Section 2.  This act shall take effect January 1, 2002.

26                          HOUSE SUMMARY

      Provides that any county may hold its second primary
28    election concurrently with the general election if all
      contests to be held at the second primary in that county
29    are open to all qualified electors regardless of party
      affiliation, with the winners of such contests being
30    automatically elected at the general election by
      operation of law applied to unopposed candidates.
