1 A bill to be entitled
2 An act relating to historic preservation;
3 creating the "Florida Historical Monuments and
4 Memorials Protection Act"; prohibiting the
5 relocation, removal, disturbance, or alteration
6 of a monument, memorial, plaque, marker, or
7 historic flag commemorating or memorializing
8 specified wars and military engagements
9 displayed on public property of the state or
10 any of its political subdivisions; prohibiting
11 a person or organization from preventing the
12 public or private body responsible for the
13 protection, preservation, or care of any
14 monument, memorial, plaque, marker, or historic
15 flag from exercising its responsibility to
16 provide such protection, preservation, or care;
17 providing a penalty for violation; prohibiting
18 the renaming or rededication of a street, park,
19 bridge, building, school, preserve, reserve, or
20 other public area of the state or any of its
21 political subdivisions dedicated in memory of
22 or named for any historic figure or event;
23 providing an effective date.

25 WHEREAS, it is a proper endeavor for a society to
26 remember and respect the symbols of its military history and
27 the valor, sacrifice, and patriotism of all its sons and
28 daughters, and
29 WHEREAS, it is also fitting and proper for a society to
30 remember, respect, honor, and recognize the history and

1 heritage and the many contributions of all of the citizenry of
2 a society, and
3 WHEREAS, it is remembrance and respect for the past
4 that provides the path for mutual understanding and respect in
5 the future, NOW, THEREFORE,

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. (1) This act shall be known and may be
10 cited as the "Florida Historical Monuments and Memorials
11 Protection Act."
12 (2) No monument, memorial, plaque, marker, or historic
13 flag commemorating or memorializing the American Revolutionary
14 War, the War of 1812, the Mexican War, the Civil War, the
15 Spanish-American War, World War I, World War II, the Korean
16 War, the Vietnam War, the Persian Gulf War, or the
17 Native-American War displayed on public property of the state
18 or any of its political subdivisions may be relocated,
19 removed, disturbed, or altered.
20 (3) No person or organization may prevent the public
21 or private body responsible for the protection, preservation,
22 or care of any monument, memorial, plaque, marker, or historic
23 flag enumerated in subsection (1) from exercising its
24 responsibility to protect, preserve, or care for such
25 monument, memorial, plaque, marker, or historic flag. A person
26 who violates the provisions of this subsection commits a
27 misdemeanor of the second degree, punishable as provided in s.
28 775.082 or s. 775.083.
29 (4) No street, park, bridge, building, school,
30 preserve, reserve, or other public area of the state or any of

1 its subdivisions dedicated in memory of or named for any
2 historic figure or event may be renamed or rededicated.
3 Section 2. This act shall take effect upon becoming a
4 law.

7 HOUSE SUMMARY

Creates the "Florida Historical Monuments and Memorials
9 Protection Act." Prohibits the relocation, removal,
disturbance, or alteration of a monument, memorial,
10 plaque, marker, or historic flag commemorating or
memorializing specified wars and military engagements
11 displayed on public property of the state or any of its
political subdivisions. Prohibits any person or
12 organization from preventing the public or private body
responsible for the protection, preservation, or care of
13 such monument, memorial, plaque, marker, or historic flag
from exercising its responsibility to provide protection,
14 preservation, or care. Provides a second degree
misdemeanor penalty for violation.
