  1                      A bill to be entitled

  2         An act relating to the re-creation of the

  3         Nongame Wildlife Trust Fund without

  4         modification; re-creating the trust fund;

  5         carrying forward current balances and

  6         continuing current sources and uses thereof;

  7         providing an effective date.

  8

  9         WHEREAS, the Legislature wishes to extend the life of

10  the Nongame Wildlife Trust Fund, which is otherwise scheduled

11  to be terminated pursuant to constitutional mandate, and

12         WHEREAS, the Legislature has reviewed the trust fund

13  before its scheduled termination date and has found that it

14  continues to meet an important public purpose, and

15         WHEREAS, the Legislature has found that existing public

16  policy concerning the trust fund sets adequate parameters for

17  its use, NOW, THEREFORE,

19  Be It Enacted by the Legislature of the State of Florida:

20

21         Section 1.  (1)  The Nongame Wildlife Trust Fund within

22  the Fish and Wildlife Conservation Commission, FLAIR Number

23  77-2-504, which is to be terminated pursuant to Section 19(f),

24  Article III of the State Constitution on November 4, 2004, is

25  re-created.

26         (2)  All current balances of the trust fund are carried

27  forward, and all current sources and uses of the trust fund

28  are continued.

29         Section 2.  This act shall take effect November 4,

30  2004.
