  1                      A bill to be entitled

  2         An act relating to youthful offenders; amending

  3         s. 958.11, F.S.; providing for certain inmates

  4         to be assigned to a facility for youthful

  5         offenders as a residential assignment if the

  6         inmate's mental or physical vulnerability may

  7         jeopardize the inmate's safety; providing

  8         legislative intent with respect to housing all

  9         inmates under a specified age in facilities for

10         youthful offenders; providing an effective

11         date.

13  Be It Enacted by the Legislature of the State of Florida:

15         Section 1.  Subsection (6) of section 958.11, Florida

16  Statutes, is amended to read:

17         958.11  Designation of institutions and programs for

18  youthful offenders; assignment from youthful offender

19  institutions and programs.--

20         (6)  The department may assign to a youthful offender

21  facility, as a residential assignment, any inmate, except a

22  capital or life felon, whose age does not exceed 19 years but

23  who does not otherwise meet the criteria of this section, if

24  the Assistant Secretary for Youthful Offenders determines that

25  such inmate's mental or physical vulnerability may would

26  substantially or materially jeopardize his or her safety in a

27  nonyouthful offender facility. It is the intent of the

28  Legislature that any inmate whose age does not exceed 18 years

29  be housed in a facility for youthful offenders, unless the

30  inmate presents an unacceptable disciplinary problem at that

  1  facility. Assignments made under this subsection shall be

  2  included in the department's annual report.

  3         Section 2.  This act shall take effect July 1, 2001.
