  1                      A bill to be entitled

  2         An act relating to driver improvement schools;

  3         amending s. 318.1451, F.S.; eliminating the

  4         prohibition against governmental entities

  5         providing or maintaining certain information or

  6         orders regarding such schools or course

  7         providers; providing an effective date.

  8

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Subsection (5) of section 318.1451, Florida

12  Statutes, is amended to read:

13         318.1451  Driver improvement schools.--

14         (5)(a)  No governmental entity or court shall provide,

15  issue, or maintain any information or orders regarding driver

16  improvement schools or course providers, with the exception of

17  directing inquiries or requests to the local telephone

18  directory heading of driving instruction or the traffic school

19  reference guide. However, The department is authorized to

20  maintain the information and records necessary to administer

21  its duties and responsibilities for driver improvement

22  courses. Where such information is a public record as defined

23  in chapter 119, it shall be made available to the public upon

24  request pursuant to s. 119.07(1).

25         (b)  The department shall prepare for any governmental

26  entity to distribute a traffic school reference guide which

27  shall list the benefits of attending a driver improvement

28  school, but under no circumstance may any list of course

29  providers or schools be included, and shall refer further

30  inquiries to the telephone directory under driving

31  instruction.

  1         Section 2.  This act shall take effect July 1, 2001.
