  2         An act relating to drivers' licenses; creating

  3         s. 322.0515, F.S.; providing for compliance

  4         with federal requirements by certain applicants

  5         for drivers' licenses or identification cards;

  6         directing the Department of Highway Safety and

  7         Motor Vehicles to forward certain information

  8         to the federal Selective Service System with

  9         respect to certain applicants; providing

10         described notice to applicants; directing the

11         department to include a described statement on

12         certain applications for drivers' licenses or

13         identification cards; providing an effective

14         date.

16         WHEREAS, it is the intent of the Legislature through

17  the adoption of this act to protect state residents from the

18  penalties associated with the failure to register with the

19  Selective Service System and to help ensure that any future

20  draft is fair and equitable to all potential draftees, and

21         WHEREAS, the Legislature finds that the penalties

22  associated with noncompliance with the Selective Service

23  System registration requirements are severe, including, but

24  not limited to, a felony conviction and forfeiture of the

25  ability to seek employment from certain state agencies and

26  departments, and

27         WHEREAS, failure to register may permanently preclude

28  the violator from acquiring many federal benefits, such as

29  federal employment, including employment with the United

30  States Postal Service, federal and state financial assistance,

31  participation in federally funded job training programs, and

  1  eligibility for United States citizenship for immigrants

  2  seeking citizenship, and

  3         WHEREAS, in recognition of the severe consequences of

  4  noncompliance and the importance of helping to ensure that any

  5  future military draft is fair and equitable, it is the intent

  6  of the Legislature to notify state residents of their

  7  responsibility to register with the Selective Service System

  8  and to provide these citizens with the opportunity to register

  9  concurrent with application for a driver's license or

10  identification card, NOW, THEREFORE,

11

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 322.0515, Florida Statutes, is

15  created to read:

16         322.0515  Department to forward certain information to

17  federal Selective Service System; notification to applicant

18  for certain license; application statement required.--

19         (1)  The department shall:

20         (a)  Require any male United States citizen or

21  immigrant who is at least 18 years of age but less than 26

22  years of age to comply with federal Selective Service System

23  requirements when applying to receive a driver's license, a

24  learner's driver's license, a commercial driver's license, an

25  identification card, or the renewal or duplicate card or

26  license as described in this chapter.

27         (b)  Forward to the federal Selective Service System

28  information about applicants for a license or card as

29  described in paragraph (a) in an electronic format to assist

30  in compliance with federal Selective Service System

31  requirements.

  1         (c)  Provide notification to each applicant for a

  2  license or card as described in paragraph (a) that an

  3  applicant's submission of the application serves to certify

  4  that the applicant either has complied with federal Selective

  5  Service System requirements or is authorizing the department

  6  to forward to the Selective Service System the information

  7  necessary for registration.

  8         (d)  Notify an applicant for a license or card as

  9  described in paragraph (a) who is under 18 years of age that

10  the applicant will be registered upon attaining 18 years of

11  age as required by federal law.

12         (2) The department shall provide, by rule, for the

13  following statement to be included on an application for a

14  license or card as described in paragraph (1)(a):  "By

15  submitting this application, I am consenting to registration

16  with the federal Selective Service System, if so required. If

17  under 18 years of age, I understand that I will be registered

18  when I attain 18 years of age as required by federal law."

19         Section 2.  This act shall take effect July 1, 2001.
