  2         An act relating to district school personnel;

  3         amending s. 231.40, F.S.; providing for use of

  4         employees' sick leave by their family members

  5         who also are district employees; providing for

  6         use of donated sick leave and restrictions;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Paragraph (e) is added to subsection (3) of

12  section 231.40, Florida Statutes, to read:

13         231.40  Sick leave.--

14         (3)  PROVISIONS GOVERNING SICK LEAVE.--The following

15  provisions shall govern sick leave:

16         (e)  Use by family member.--Each district school system

17  must provide a policy under which a district employee may

18  authorize his or her spouse, child, parent, or sibling who is

19  also a district employee to use sick leave that has accrued to

20  the authorizing employee. In developing the policy, the

21  district school board must provide that the recipient may not

22  use the donated sick leave until all of his or her sick leave

23  has been depleted, excluding sick leave from a sick leave

24  pool, if the recipient participates in a sick leave pool.

25  Donated sick leave under this paragraph shall have no terminal

26  value as provided in s. 231.40(3).

27         Section 2.  This act shall take effect July 1, 2001.
