1 A bill to be entitled
2 An act relating to solid waste management
3 facilities; amending s. 403.707, F.S.;
4 requiring any solid waste management facility
5 that accepts construction and demolition debris
6 for disposal to be constructed in compliance
7 with certain rules of the Department of
8 Environmental Protection, unless the facility
9 owner or operator provides reasonable assurance
10 that disposal at the facility is not expected
11 to result in violations of groundwater
12 standards; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Paragraph (b) of subsection (12) of section
17 403.707, Florida Statutes, is amended to read:
18 403.707 Permits.--
19 (12) The department shall establish a separate
20 category for solid waste management facilities which accept
21 only construction and demolition debris for disposal or
22 recycling. The department shall establish a reasonable
23 schedule for existing facilities to comply with this section
24 to avoid undue hardship to such facilities. However, a
25 permitted solid waste disposal unit which receives a
26 significant amount of waste prior to the compliance deadline
27 established in this schedule shall not be required to be
28 retrofitted with liners or leachate control systems.
29 Facilities accepting materials defined in s. 403.703(17)(b)
30 must implement a groundwater monitoring system adequate to

1 detect contaminants that may reasonably be expected to result
2 from such disposal prior to the acceptance of those materials.
3 (b) Any facility that accepts construction and
4 demolition debris for disposal must be constructed with a
5 liner and leachate control system that complies with
6 department rules, unless the owner or operator provides
7 reasonable assurance The department shall not require liners
8 and leachate collection systems at individual facilities
9 unless it demonstrates, based upon the types of waste
10 received, the methods for controlling types of waste disposed
11 of, the proximity of groundwater and surface water, and the
12 results of the hydrogeological and geotechnical
13 investigations, that the facility is not reasonably expected
14 to result in violations of groundwater standards and criteria
15 otherwise.
16 Section 2. This act shall take effect upon becoming a
17 law.

Requires any solid waste management facility that accepts

23 complies with rules of the Department of Environmental
Protection, unless the facility owner or operator
