13         Amendment to Amendment (024815) (with title amendment) 
14         On page 1, line 18, through page 2, line 19, of the
15  amendment,
16  remove from the amendment:  all of said lines,
17  
18  and insert in lieu thereof:  
19         112.18  Firefighters, correctional officers, and state,
20  county, or municipal law enforcement officers; special
21  provisions relative to disability.--
22         (1)  Any condition or impairment of health of any
23  Florida state, municipal, county, port authority, special tax
24  district, or fire control district firefighter, correctional
25  officer as defined in s. 943.10(2) and (3), or state, county,
26  or municipal law enforcement officer caused by tuberculosis,
27  heart disease, or hypertension resulting in total or partial
28  disability or death shall be presumed to have been accidental
29  and to have been suffered in the line of duty unless the
30  contrary be shown by competent evidence. However, any such
31  firefighter, correctional officer, or state, county, or

HOUSE AMENDMENT hbd-032 Bill No. HB 649 Amendment No. ___ (for drafter's use only) 1 municipal law enforcement officer shall have successfully 2 passed a physical examination upon entering into any such 3 service as a firefighter, correctional officer, or state, 4 county, or municipal law enforcement officer, which 5 examination failed to reveal any evidence of any such 6 condition. Such presumption shall not apply to benefits 7 payable under or granted in a policy of life insurance or 8 disability insurance, unless the insurer and insured have 9 negotiated for such additional benefits to be included in the 10 policy contract. 11 (2) This section shall be construed to authorize the 12 above governmental entities to negotiate policy contracts for 13 life and disability insurance to include accidental death 14 benefits or double indemnity coverage which shall include the 15 presumption that any condition or impairment of health of any 16 firefighter caused by tuberculosis, heart disease, or 17 hypertension resulting in total or partial disability or death 18 was accidental and suffered in the line of duty, unless the 19 contrary be shown by competent evidence. 20 Section 2.
