18 Section 3. Section 316.1923, Florida Statutes, is
19 created to read:
20 316.1923 Aggressive careless driving.--Aggressive
21 careless driving is defined as committing two or more of the
22 following acts simultaneously or in succession:
23 (1) Exceeding the posted speed as defined in s.
24 322.27(3)(d)5.b.
25 (2) Unsafely or improperly changing lanes as defined
26 in s. 316.085.
27 (3) Following another vehicle too closely as defined
28 in s. 316.0895(1).
29 (4) Improperly passing as defined in s. 316.083, s.
30 316.084, or 316.085.
31 (5) Violating traffic control and signal devices as

1 defined in s. 316.074 or s. 316.075.
2 Section 4. Paragraph (a) of subsection (1) of section
3 316.650, Florida Statutes, is amended to read:
4 316.650 Traffic citations.--
5 (1)(a) The department shall prepare, and supply to
6 every traffic enforcement agency in this state, an appropriate
7 form traffic citation containing a notice to appear (which
8 shall be issued in prenumbered books with citations in
9 quintuplicate) and meeting the requirements of this chapter or
10 any laws of this state regulating traffic, which form shall be
11 consistent with the state traffic court rules and the
12 procedures established by the department. Upon all future
13 printings of the traffic citation, the form must include a
14 special box that is to be checked by the law enforcement
15 officer when the officer believes that the traffic violation
16 or crash was caused due to aggressive careless driving as
17 defined in s. 316.1923.
18 Section 5. The Department of Highway Safety and Motor
19 Vehicles shall prepare a report to the President of the Senate
20 and the Speaker of the House of Representatives by December 1,
21 2002, which sets forth the numbers of incidents of aggressive
22 careless driving in this state.
23 Section 6. This act shall take effect upon becoming a
24 law, except that sections 1 and 2 of this act shall take
25 effect January 1, 2002.

2 enhanced penalties; creating s. 316.1923, F.S.;
3 defining "aggressive careless driving" for
4 purposes of the act; amending s. 316.650, F.S.;
5 requiring that the Department of Highway Safety
6 and Motor Vehicles revise the uniform traffic
7 citation upon future printings to include a
8 special check-off box for law enforcement
9 officers to use to indicate aggressive careless
10 driving; requiring a report to the Legislature;
11 providing effective dates.
