1 A bill to be entitled
2 An act relating to enterprise zones; creating
3 s. 290.00694, F.S.; authorizing the Office of
4 Tourism, Trade, and Economic Development to
5 designate an enterprise zone in Sarasota
6 County; providing requirements with respect
7 thereto; amending s. 290.00555, F.S.; removing
8 the December 31, 1999, deadline for creation of
9 satellite enterprise zones by certain
10 municipalities and authorizing creation of such
11 zones effective retroactively to that date;
12 providing duties of the Office of Tourism,
13 Trade, and Economic Development; providing an
14 application deadline for businesses in such
15 zones which are eligible for certain sales and
16 use tax incentives; providing an effective
17 date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Section 290.00694, Florida Statutes, is
22 created to read:
23 290.00694 Enterprise zone designation for Sarasota
24 County or Sarasota County and Sarasota.--Sarasota County, or
25 Sarasota County and the City of Sarasota jointly, may apply to
26 the Office of Tourism, Trade, and Economic Development for
27 designation of one enterprise zone within the county, or
28 within both the county and the municipality, which zone
29 encompasses an area that is south of the north county line,
30 west of Tuttle Avenue, north of 10th Street, and east of U.S.
31 Highway 41. The application must be submitted by December 31,

1 2001, and must comply with the requirements of s. 290.0055.
2 Notwithstanding the provisions of s. 290.0065 limiting the
3 total number of enterprise zones designated and the number of
4 enterprise zones within a population category, the Office of
5 Tourism, Trade, and Economic Development may designate one
6 enterprise zone under this section. The Office of Tourism,
7 Trade, and Economic Development shall establish the initial
8 effective date of the enterprise zone designated under this
9 section.
10 Section 2. Section 290.00555, Florida Statutes, is
11 amended to read:
12 290.00555 Satellite enterprise zones.--Before December
13 31, 1999, Any municipality an area of which has previously
14 received designation as an enterprise zone in the population
15 category described in s. 290.0065(3)(a)3. may create a
16 satellite enterprise zone not exceeding 1.5 square miles in
17 area outside of and, notwithstanding anything contained in s.
18 290.0055(4), or any other law, in addition to the previously
19 designated enterprise zone boundaries. The Office of Tourism,
20 Trade, and Economic Development shall amend the boundaries of
21 the areas previously designated by any such municipality as
22 enterprise zones upon receipt of a resolution adopted by the
23 municipality describing the satellite enterprise zone areas,
24 as long as the additional areas are consistent with the
25 categories, criteria, and limitations imposed by s. 290.0055.
26 However, the requirements imposed by s. 290.0055(4)(d) do not
27 apply to such satellite enterprise zone areas.
28 Section 3. Satellite enterprise zones may be created
29 pursuant to section 290.00555, Florida Statutes, effective
30 retroactively to December 31, 1999. Resolutions adopted to
31 create satellite enterprise zones under this section must be

1 submitted to the Office of Tourism, Trade, and Economic
2 Development by August 1, 2001. The Office of Tourism, Trade,
3 and Economic Development must amend the boundaries of
4 previously designated enterprise zones to create eligible
5 satellite enterprise zones by September 1, 2001.
6 Notwithstanding the time limitations contained in chapter 212,
7 Florida Statutes, a business in a satellite enterprise zone
8 designated under this section which was eligible to receive
9 tax incentives pursuant to sections 212.08(5)(g) and (h) and
10 212.096, Florida Statutes, during the period beginning
11 December 31, 1999, and ending on the date of the creation of
12 the satellite enterprise zone must submit an application for
13 the tax incentives by December 1, 2001. All other requirements
14 of the enterprise zone program apply to such a business.
15 Section 4. This act shall take effect upon becoming a
16 law.

18 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
19 SB 668

21 The committee substitute makes the following changes.
22 1. The resolutions adopted to create satellite enterprise
zones must be submitted by August 1, 2001, and the
23 Office of Tourism, Trade, and Economic Development must
amend the boundaries of the previously designated
24 enterprise zones no later than September 1, 2001.
25 2. The sales tax exemption for electrical energy used in an
enterprise zone was eliminated from a list of program
26 tax incentives that are to be retroactively refunded to
businesses that may be located in a future satellite
27 enterprise zone.
